Jack Smith's Public Testimony and His Dire Warning About Elections
Strategic Vulnerability: The Evidence, the Obstruction, and the Stakes for Democracy
On the morning of December 17, 2025—the day Jack Smith sat for a closed-door deposition with the House Judiciary Committee—the Department of Justice emailed Smith’s legal team to inform them that he was precluded from discussing anything related to the unreleased Volume II of the classified documents case,¹ which Judge Aileen Cannon blocked from being released in January 2025.²
Why is this important? Seven days after Trump lost the 2020 election to President Joe Biden, the Senate rammed through Judge Aileen Cannon—a Federalist Society loyalist—to the federal bench, via the nuclear option.³ The seat? It would later oversee Trump’s classified documents case.⁴
Think about that.
Before he even walked out of the White House with stolen classified documents and a failed insurrection attempt, Donald Trump had already secured the judge who would protect him. He wasn’t just breaking the law—he was fortifying his legal escape route in advance, with an assist from Senate Republicans.
What’s In Those Classified Documents
Subject matter Smith clearly wants to address. His own attorney has stated that his testimony is being “hindered” by both the DOJ and Judge Cannon.¹
Subjects such as Ted Cruz and his secret conversation with Maria Bartiromo prior to January 6. What “mechanism” was being discussed to keep Trump in office? The fake electors. The insurrection itself—deliberately stalling the certification of the vote to assemble a commission and use those fake electors to install Trump.⁵ “Vote your conscience”—right, Ted?
And what was Jack Smith’s dire warning? That covering up election crimes would be “catastrophic” for democracy.⁶
For the past decade, we’ve watched the judiciary, political appointees, and legislators move mountains to protect Donald Trump—from Bill Barr’s handling of the Mueller Report⁷ and the suppression of anything related to Epstein,⁸ to Pamela Jo Bondi and the daily lawlessness of her corrupt Department of Justice.⁹
At this point, many of us no longer question how deeply our government has been infiltrated by bad actors determined to keep Donald Trump in power—to protect his “friends”¹⁰ implicated in the Epstein files—and to dismantle democracy and the rule of law.
Premeditated Insurrection
Why did Jack Smith say the insurrection wouldn’t have occurred without Donald Trump? Because, as demonstrated by his use of the D.C. National Guard in June 2020 during the peaceful BLM protest, Trump was fully aware that the Guard operated under his authority.¹¹
He not only failed to deploy the Guard to defend the Capitol on January 6, but also blocked deployment requests in advance through then–Secretary of Defense Christopher Miller and Secretary of the Army Ryan McCarthy¹²—despite a sharp rise in permits to assemble and well-documented indicators of potential violence from the Proud Boys and their affiliated networks.¹³
On January 1, 2021, Maj. Gen. William Walker recommended a full deployment. That authority was administratively neutralized by SecDef Miller and SecArmy McCarthy on behalf of the Office of the President.

Rather than authorizing the full deployment of roughly 1,100 D.C. National Guard troops available in 2021 to guard the Capitol and support civil authorities in the District of Columbia, Secretary of the Army Ryan McCarthy—at the direction of Secretary of Defense Christopher Miller—limited the mission to just 340 unarmed personnel, dispersed across traffic control points, Metro station support, and Joint Base Andrews support, with no troops assigned to the Capitol itself.¹⁴
“DCNG are not authorized to perform any additional tasks or duties not authorized in this memorandum. In addition, without my personal authorization, the DCNG is not authorized the following:”
to carry any weapons including batons,
to deploy any riot control agents,
to share equipment with law enforcement agencies,
to use Intelligence, Surveillance, and Reconnaissance assets,
to employ helicopters or any other air assets,
to conduct searches, seizures, arrests, or other similar direct law enforcement activities,
to seek support from any non-DCNG National Guard units.
From McCarthy, “I withhold authority to approve employment of the DCNG Quick Reaction Force (QRF) and will do so only as a last resort, in response to a request from an appropriate civil authority.”
Just so we’re clear: 340 unarmed troops were dispatched for a traffic-control mission, and if they encountered an emergency, they were not permitted to call in backup from other National Guard units.
Strategic Vulnerability
Donald Trump didn’t just sit there eating a burger for over three hours as the Capitol was breached—he and his associates created the conditions that left the Capitol unguarded, enabling a premeditated effort to halt the January 6 certification of the vote and block the peaceful transfer of power: a “mechanism” to keep him in the presidency, despite knowing full well that he had lost the election.¹⁵
As Smith testified in December, their investigation developed proof beyond a reasonable doubt that Donald Trump and his loyalists “engaged in a criminal scheme to overturn the results of the 2020 election and to prevent the lawful transfer of power.”
He went on to say, “Our investigation also developed powerful evidence showing that President Trump willfully retained highly classified documents after he left office in January 2021, storing them at his social club, including in a ballroom and a bathroom. He then repeatedly attempted to obstruct justice to conceal his continued retention of those documents.”¹⁶
Phone records and the stolen classified documents would almost certainly reveal who participated, who coordinated, and who should have been charged accordingly for election-related crimes tied to the 2020 election.
Beyond a Reasonable Doubt
We are well aware that Donald Trump was facing 44 felony indictments¹⁷ and was heading to prison if he didn’t “win” the 2024 election. We also know that prior to Inauguration Day on January 21, 2025, federal agencies had at least 32 open investigations into Elon Musk’s companies.¹⁸
And we know on October 25, 2024, The Wall Street Journal published a bombshell report that Musk had been in regular communication with Vladimir Putin for roughly two years,¹⁹ and earlier reporting revealed that Starlink access had been provided to Russian forces.²⁰
In an interview with Tucker Carlson, Musk stated that if Trump did not win the election, he would be “fu*ked” and “going to prison,” questioning how he would see his children.²¹
Aid to an enemy. Also known as treason.
A Watershed Moment
Two of the most powerful men in the world faced prison sentences if Donald Trump did not win the 2024 election. And yet, Democrats chose to ignore all of the following:²²
The 2020–2021 illegal breach of voting equipment in five states by Trump’s allies.
Elon Musk’s 2024 voter-information–harvesting PAC and $1 million–a-day giveaway.
The September 2024 backdoor “de minimis” updates to election equipment.
Over 1.5 million votes for Kamala Harris disappearing in real time on election night.
Ghost counties that do not exist.
Over 200 fake Russian bomb threats.
“He knows those vote-counting computers better than anyone.”
Widespread election equipment failures.
Statistically absurd, non-human election data in the swing states that does not appear in the mail-in vote.
Machine counts exceeding hand counts by 6–8%.
Burning mailboxes.
Breaks in the chain of ballot custody.
Precinct-level data that does not match state-level data.
The Pennsylvania ballot-access lawsuit, where votes cast exceeded registered voters in some counties by as much as 1,265.52%.

Over 41% of the Democratic Party’s base does not believe Donald Trump won the 2024 election, and acknowledging the circumstances outlined above does not make us “like them.”
President Biden won the 2020 election by nearly 7 million votes.
There is no comparison between the circumstances of the 2020 election and those of the 2024 election. The two are not even remotely similar.
Why This Matters
We have been circulating the data and exposing election corruption for the past year, with no response from the media or the Democratic Party. Attempting to hold the midterms on the same compromised voting equipment used in the 2024 election is both a recipe for failure and the definition of insanity.
The Democratic Party is hemorrhaging public trust as its leadership attempts to gaslight voters into believing that Elon Musk played no role in manipulating the 2024 election to keep himself—and Donald Trump—out of prison.
At the same time, we’re learning that party leadership has shielded elites named in the Epstein files to prevent exposure of a decades-long sex-trafficking operation implicating powerful donors across party lines.²⁴ The elite are protecting the elite, and the American people are experiencing an awakening.
We are now in a “fight or resign” position. It is well past time to initiate state-led investigations. Ask state attorneys general and investigators to:
Subpoena communications between Elon Musk, Eaton, Palantir, Starlink employees, ES&S, Dominion, Pro V&V, and SLI
Investigate the voter-information–harvesting PAC started by Elon Musk
Audit Starlink satellite logs for the week of the election
Allow third-party hand-count audits of ballots
Reconcile why precinct-level data does not match state-level data
Investigate Decision Desk HQ’s (DDHQ’s) role in reporting and uploading election night data
Investigate the DOGE boys and their role in the 2024 election
This is just a start. We have constitutional avenues to remove this entire illegitimate regime. A stolen election is a rebellion against the Constitution and is disqualifying under Section 3 of the 14th Amendment.

The most important question we can ask right now: What election equipment are we using for the midterms? The same equipment Trump’s allies illegally breached in 2020-2021? The same equipment Elon Musk hacked to keep himself, Trump, and wealthy “friends” out of prison?
